Effective February 1, 2026. Issued by ImmiLaw Vietnam Co., Ltd, Hanoi. This document sets out the legal framework governing your use of this website, the engagement of our services and the processing of your personal data.
Important Disclaimer — We Are an Intermediary, Not the Government
ImmiLaw.VN is operated by ImmiLaw Vietnam Co., Ltd ("the Firm"), a private legal-services intermediary registered under the laws of the Socialist Republic of Vietnam. The Firm is NOT a government agency, immigration authority, embassy or consular post. We have no official affiliation with the Vietnam Immigration Department, Ministry of Public Security, Ministry of Justice, Department of Planning & Investment, or any other Vietnamese government body. We do not issue visas, residence cards, business licenses, exit clearance letters or any other state-issued document. We act as your authorised private representative and prepare, lodge and follow up on filings with the relevant authorities strictly within the boundaries of Vietnamese law. All fees displayed on this website are our private professional service fees and are entirely separate from any government fees, charges or taxes which are paid directly to the relevant authority. The final outcome of any application is decided exclusively by the relevant government authority, not by the Firm.
Scope of Services
The Firm provides advisory and representation services in connection with: (a) visa applications and extensions, (b) overstay administrative resolution and exit clearance, (c) enterprise formation and licensing, (d) temporary residence registration with local police authorities, and (e) related ancillary matters. Acceptance of any engagement requires a written engagement letter and is subject to conflict-of-interest review. Mandate scope is delimited by the engagement letter; advisory communications outside that scope do not form part of the retainer.
Compliance & Legal Basis
Our practice is conducted in accordance with: Law on Foreigners' Entry, Exit, Transit and Residence (47/2014/QH13) and its amendments; Law on Investment (61/2020/QH14); Law on Enterprises (59/2020/QH14); Decree 152/2020/NĐ-CP on foreign labor; Decree 144/2021/NĐ-CP on administrative penalties; Circular 53/2016/TT-BCA on residence registration; Personal Data Protection Decree 13/2023/NĐ-CP; and other related normative documents. We refuse instructions that would require any action contrary to these instruments.
Personal Data & Privacy
We collect personal data strictly for the purpose of providing the services you request. Data is processed under the Vietnamese Personal Data Protection Decree 13/2023/NĐ-CP and, where applicable to clients in the European Union, in accordance with GDPR principles (lawfulness, purpose limitation, data minimisation, storage limitation, integrity, confidentiality). Documents submitted via this website are encrypted in transit (TLS 1.3) and at rest (AES-256), retained for the period required by law (minimum 5 years for administrative filings) and disclosed only to: (i) the relevant Vietnamese authority handling your matter, (ii) personnel of the Firm bound by confidentiality, (iii) court order or lawful authority request. You may request access, rectification, deletion (where lawful) and portability by writing to support@immilaw-vn.com.
Fees & Payments
All Firm fees are quoted in writing prior to engagement. State fees (visa, license, administrative penalties) are passed through at cost and are paid directly to or via the competent authority. Fixed-fee engagements are the default; hourly engagements are available for advisory matters. Online payment is processed via PayPal (USD or local currency equivalent); credit and debit card processing operates under PayPal's PCI-DSS Level 1 certification. Refund policy is set out in the engagement letter.
Communications & Privilege
Communications between you and the Firm are confidential and protected to the extent afforded by Vietnamese law. Use of the website forms a limited initial communication only; a full attorney-client relationship is established only upon execution of the engagement letter. Electronic communications (email, in-app messages) are deemed delivered when received by the Firm's mail server; reasonable steps are taken to safeguard against interception.
Intellectual Property
All content on this website — including the ImmiLaw.VN name and emblem, written materials, photographs, and educational content — is the property of ImmiLaw Vietnam Co., Ltd or its licensors. Use of the materials is permitted for personal, non-commercial reference. Republication requires written consent. Unauthorised commercial use is pursued under Articles 198 ff., Law on Intellectual Property (50/2005/QH11) as amended.
Accessibility
We design this website to meet WCAG 2.1 Level AA where feasible: keyboard navigation, sufficient colour contrast, alternative text for non-decorative images, and resizable text. Should you encounter a barrier or require an alternative format, write to support@immilaw-vn.com with the subject "Accessibility request" and we will respond within five working days.
Limitation of Liability
The Firm exercises professional care but does not guarantee outcomes, as final determinations rest with the competent Vietnamese authority. Liability is limited as set forth in the engagement letter. Nothing in this policy excludes or limits liability for fraud, wilful misconduct or any other liability that may not be excluded under Vietnamese law.
Governing Law & Jurisdiction
This policy and any non-contractual obligations arising from it are governed by the laws of the Socialist Republic of Vietnam. Any dispute arising out of or in connection with this policy shall be subject to the exclusive jurisdiction of the courts of Hanoi, save where the engagement letter elects arbitration before VIAC under its expedited rules.
Updates to this Policy
We review this policy at least annually and after any material change in operations or applicable law. The current version is dated below. Material changes are communicated to existing clients by email; minor edits (typography, clarification) are versioned silently and noted in the revision log retained at our Hanoi office.
