Overstay & Extension Report

Visa extensions, overstay penalty assessment and exit-clearance reporting — resolve status issues before they compound into bans.

Apply now

Overview

Overstaying a Vietnamese visa triggers administrative fines under Decree 144/2021/ND-CP that scale with the length of overstay — and prolonged or repeated overstays can lead to exit formalities being withheld, deportation orders and multi-year re-entry bans.

Where you are still in status, an extension may be available depending on your visa category: business visas with a sponsor, family categories, and certain other cases can be extended at the Immigration Department without leaving the country. E-Visas cannot be extended directly and require a new application or category change.

ImmiLaw.VN assesses your record, estimates the penalty exposure, prepares the overstay report or extension dossier, and files it with the Immigration Department — then follows through to exit clearance or a new visa so you can continue or conclude your stay lawfully.

Eligibility

  • Extension: current visa category must be extendable with a valid sponsor or ground (business, family, investment)
  • Overstay report: any foreign national whose permitted stay has expired, regardless of duration
  • Exit clearance: overstayers intending to depart Vietnam after penalty settlement
  • Passport must be valid — renew first if it has expired

Do not attempt to exit Vietnam with an expired visa without a clearance — border officers will refer you back to the Immigration Department, often missing your flight. Settle the overstay first.
